CBL Consulting Ltd is a Chartered Practice with Directors Registered with the IStructE, ICE and the Engineering Council that is committed to respecting and protecting your privacy. Our Privacy Policy together with our standard Terms & Conditions along with any other documents referred to within sets out how any personal data we collect from you either directly, on or through this Website is processed, in accordance with The Data Protection (Bailiwick of Guernsey) Law, 2017.

 

 

1.     Collecting information via this website

This website collects Personal Data such as name, address, telephone number and email address through various means, such as site registration, questions, comments and communications to the Site, and postings, if any. We may collect your IP (Internet Protocol) address to help diagnose problems with our server and to administer our site. An IP address is a number that is assigned to your computer when you use the internet. This information does not in itself contain any personally identifiable information, but your IP address may be used to help identify you during a particular session and to gather broad demographic data.

2.     What data do we collect & why?

  • Personal Data: This includes business names, personal names, addresses, telephone numbers, email addresses, etc.

  • Special Category Data: This includes race, religion, political interests, sexual interests, physical and mental health. Please note that CBL Consulting do not routinely collect or record this Special Category Data.

Note: In the event of any project-specific requirement for special data acquisition relating to any of the above CBL will specifically request your consent to process this.

3.     Purpose of processing your Personal Data & Special Category Data:

We use your Personal Data for the following purposes:-

  • The processing of Personal Data is necessary for the performance of a contract to which the data subject is a party or that it is in the interests of the data subject.

  • Maintenance of contact & communication with you during your dealings with CBL Consulting Ltd.

  • Maintenance of our own records & accounts.

  • The purchase of materials/goods/services from you.

  • Special Category Data, for health or social care purposes or that relating to Police Checks.

  • If the Owner fails or is unable to provide the information we require to undertake our commission, we may not be able to provide the full service expected.

Retention:

Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed/for as long as it is necessary in conjunction with our Professional Indemnity and other insurances/collateral warranty agreements & contracts.

Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfil such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.

We use your Special Category Data for the following purposes:-

  • Maintenance of contact & communication with you during your dealings with CBL Consulting Ltd

  • Maintenance of our own records & accounts.

  • The purchase of materials/good/services from you.

Any Special Category Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed/for as long as it is necessary in conjunction with our Professional Indemnity, Legal/Tax purposes and other insurances/collateral warranty agreements & contracts.

4.     Data for Employment & Recruitment Purposes:

By applying for a job, answering screening questions, providing your contact details, providing your CV/portfolio to show an interest in a job, or replying to a message from a potential Employer, you agree to the disclosure of your information to that Employer.

Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed/for as long as it is necessary.

Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfil such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.

 

 

5.     Where do we get the data from?

  • You – from our conversations, emails and other communications.

  • Publicly accessible sources – websites, companies house, social media and research as part of any due diligence process/procedures.

  • References – from your previous activities, such as employment.

6.     Who do we share the data with?

In order to provide our services, we may share some data with our staff and other people in other companies, such as consultants and suppliers. However, we value confidentiality and all sensitive information will only be shared with your expressed authority, unless we are legally obliged to disclose it.

Where do we keep the data?

We keep data in a number of formats in our offices and on our servers, which are located in our offices and in digital form on our office devices. We have different authority levels on who has access to this information on a tiered basis on the levels of confidentiality. There is no public or unsupervised access to information held, and all visitors need to pass through a separate entrance area to our offices. Data is also kept within a separate server hosted on island.

7.     How long do we keep your Personal Data & Special Category Data?

The Personal Data that we collect & hold shall be processed and stored only for as long as required by CBL Consulting ltd for the purpose(s) they have been collected for.

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed/for as long as it is necessary in conjunction with our Professional Indemnity and other insurances/collateral warranty agreements & contracts.

  • Personal Data collected for the purposes of the Owner’s legitimate interests shall be retained as long as needed to fulfil such purposes.

  • Special Category Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed/for as long as it is necessary in conjunction with our Professional Indemnity and other insurances/collateral warranty agreements & contracts.

 

The Owner may be allowed to retain Personal Data / Special Category Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data / Special Category Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data / Special Category Data shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after the expiration of the retention period.

8.     What does it mean to you?

Where the condition for lawful processing we rely upon is consent rather than contractual, you have the right to withdraw this consent and we will cease processing activities governed by this consent. Please note this will not invalidate the contract, only processing governed by that consent.

Note that if we do start to hold your data, we may be obliged to use or retain your data, for example, if requested by law or to support a legal claim; you will not have rights over this. As an individual, you have rights regarding your data. They are:

  • The right to be informed

  • The right of access

  • The right of rectification

  • The right of erasure

  • The right to restrict processing

  • The right to data portability

  • The right to object

  • Rights in relation to automated decision-making and profiling

We may make changes/update our privacy policy in the future. Any changes we may make will be posted on this page and where it is deemed appropriate, notified to you by email.
